Creative Array Studios Waiver and Release of Liability

Please carefully read the following as it is a legally binding contract.

This Waiver and Release is for the benefit of Creative Array Studios, LLC, a [state of incorporation] limited liability company (the “Company”), and all of the Company’s affiliates, employees, officers, directors, managers, owners, agents, and any other associated entities or individuals (hereinafter collectively referred to as “Creative Array Studios”). Creative Array Studios offers a variety of activities, including but not limited to a splatter painting experience, paint-and-sip events, DIY crafts, and other art-related projects. These services are provided in a social and creative environment, and participants may also engage in activities that include the optional consumption of alcohol at their personal election and sole responsibility.

By signing this Waiver and Release, the individual(s) named below (individually and collectively, the “Participant”) voluntarily agrees to the following terms and conditions:

1. Assumption of All Known and Unknown Risks

The Participant understands and agrees that participation in activities at Creative Array Studios involves inherent risks, including but not limited to:

• Risks of injury or damage to clothing and personal property from paint, art supplies, or tools.

• Risks associated with the use of sharp or heated tools (e.g., scissors, hot glue guns, soldering irons).

• Risks related to allergic reactions to materials or substances provided by Creative Array Studios.

• Risks related to the optional consumption of alcohol in conjunction with art tools or activities.

• Risks of slip-and-fall accidents or other injuries due to the nature of the activities offered.

These risks may result in serious bodily injury, emotional harm, property damage, or other losses. Participants voluntarily assume full responsibility for these risks, whether known or unknown, and regardless of whether they are caused by the actions or negligence of Creative Array Studios or other participants.

2. Waiver and Release of All Claims; Covenant Not to Sue

In consideration of being allowed to participate in the activities and services provided by Creative Array Studios, the Participant (and/or the undersigned parent or guardian, if applicable) hereby voluntarily:

• Releases, waives, and forever discharges Creative Array Studios and its affiliates, employees, agents, and representatives from any and all claims, demands, or causes of action related to participation in the activities.

• Agrees not to bring any legal action or claims against Creative Array Studios for any injuries, losses, or damages incurred, whether caused by negligence or otherwise, to the fullest extent allowed by law.

3. Indemnification

The Participant (and/or the undersigned parent or guardian) agrees to indemnify and hold harmless Creative Array Studios and its representatives from and against any and all claims, damages, liabilities, costs, and expenses (including attorney’s fees) arising from the Participant’s actions or participation.

4. Rules and Responsibilities

The Participant agrees to:

• Follow all posted rules, verbal instructions, and safety guidelines provided by Creative Array Studios.

• Notify staff of any allergies, medical conditions, or sensitivities prior to participating in activities.

• Refrain from consuming alcohol if under the legal drinking age and assume all responsibility for the consumption of alcohol if legally permitted.

5. Media Release

The Participant grants permission to Creative Array Studios to use photographs, videos, or other media of the Participant for promotional purposes, including but not limited to social media, websites, and marketing materials. The Participant waives any right to compensation or claims arising from the use of such media.

6. Parties and Deposits

A non-refundable deposit is required at the time of booking any private event or party. All children under the age of 10 (including siblings) count toward the guest total for children’s parties. Additional fees may apply for guests exceeding the agreed party size. Guests are required to sign this waiver prior to participation.

7. Age Requirements and Parental Consent

Participants must be 18 years of age or older to sign this Waiver and Release. If the Participant is under 18 years of age, a parent or legal guardian must sign on their behalf and assumes all responsibility for the minor’s safety and adherence to these terms.

8. Miscellaneous

This Waiver and Release shall be governed by the laws of Missouri. Venue for any disputes shall be in the courts of St. Charles County, MO. If any provision of this Waiver is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

By signing below, the Participant (and/or the undersigned parent or guardian) acknowledges that they have read, understand, and voluntarily agree to this Waiver and Release. The Participant further understands that this document is a binding legal contract that waives certain rights.
